M.I.S.S. CONSULT Co., Ltd. (from now on referred to as the "Company") recognizes and prioritizes the protection of the personal data of its service users and adheres strictly to respecting the privacy rights of its service users.
This Privacy Notice ("Notice") is intended to inform you, as a user of the Company's services, of the details regarding the purposes of collecting, using, or disclosing (collectively referred to as "processing") personal data, as well as your rights under the Personal Data Protection Act B.E. 2562 (2019).
The Company processes your data for the purposes stated in this Notice as a Data Controller, meaning that the Company has the authority to make decisions regarding collecting, using, or disclosing personal data.
Definitions
"Personal Data" means any information relating to an individual that enables the identification of that individual, whether directly or indirectly, but not including the data of deceased persons. "Sensitive Personal Data" means personal data that is inherently private and may be at risk of unfair discrimination, such as race, ethnicity, political opinions, beliefs in religion, philosophy, sexual behavior, criminal history, health information, disabilities, labor union information, genetic data, biometric data, or any other data that affects the data subject similarly as prescribed by the Personal Data Protection Committee. "Company" means M.I.S.S. CONSULT Co., Ltd. "Employee" means an officer or employee of the Company under the Labor Protection Act B.E. 2541 (1998) and its amendments. "Service Users of the Company" include: "Test Taker" means a person who participates in the assessment of psychological tools through tests, surveys, or questionnaires, either in paper or online format, conducted by the Company or its network, including both the Company's standard tests and tests that the Company researches and develops for groups, juristic persons, government agencies, and state organizations. "Trainee" means a person who participates in training courses conducted by the Company or its network, including classroom training courses, online training courses, and self-learning through the e-learning system. "Instructor" means someone who imparts knowledge and experience to trainees in various courses organized by the Company or its network. "Website User" means a person who accesses the websites of M.I.S.S. CONSULT Co., Ltd.: missconsult.com, missconsult.org, disc-thailand.com, missconsult.typeform.com, mc-wisdom.com, missconsult.questionpro.com, psychometrictestcenter.missconsult.com "Other Related Persons" means persons involved in the operations of M.I.S.S. CONSULT Co., Ltd. other than trainees, instructors, and website users.
The Company's Collection, Use, or Disclosure of Your Data
Collection of Personal Data The Company will collect personal data such as name, surname, telephone number, and email address for purposes, scope, and by lawful and fair means. The collection will be done only to the extent necessary for the Company's operations under its objectives. The Company will ensure that the data subject is aware of and consents electronically or by the Company's methods. In the case of collecting sensitive personal data, the Company will explicitly request permission from the data subject before collection unless the collection of personal data and sensitive personal data falls under the exceptions prescribed by the Personal Data Protection Act B.E. 2562 (2019) or other laws.
Purposes of Collecting and Using Your Data The Company collects your data for the following purposes:

For the recruitment and selection of test takers and trainees, developing and promoting individual potential in various courses organized by the Company or its network, for which applicants register or submit applications through designated channels.

Prepare lists or documents introducing trainees to various courses organized by the Company and its network and distribute them to course trainees.

To prepare lists and resumes of course instructors and distribute them to trainees.

To create alumni directories for various courses and distribute them to trainees.

To process and prepare test result reports, individual development plans, and overall analysis reports from the assessment of psychological tools through tests, surveys, or questionnaires, both in paper and online format, conducted by the Company or its network.

To process and prepare training result reports for various courses organized by the Company or its network.

To process and prepare statistical reports of trainees through various learning channels on the Company's website system.

To create and publish videos related to training for trainees to review.

To disburse training registration fees and instructor compensation.

To contact and communicate information to trainees.

To create promotional materials for the Company's courses, which may include trainees or instructors as part of the media.

For the management of training or other internal activities of the Company.

For the security of buildings, premises, or training venues.

Disclosure of Your Data The Company may disclose your data to the following types of individuals and channels:

Your affiliated organizations, for example if the organization requests in writing for the Company to send reports on trainees who are personnel within the organization's affiliation.

Government officials, agencies with authority, or other persons are responsible for actions prescribed by law, orders of authorities, court orders, etc.

Network agencies, contractors, service providers, or related persons necessary for the Company's services related to your data, such as database service providers, document delivery providers, or website developers.

Public announcements, in cases such as announcing the names of trainees, course instructors, video clips of training-related activities, promotional materials that include trainees or instructors, through the Company's websites (missconsult.com, missconsult.org, disc-thailand.com, missconsult.typeform.com, mc-wisdom.com, missconsult.questionpro.com, psychometrictestcenter.missconsult.com) and announcements through social media channels like Facebook and YouTube of the Company.
In cases where the disclosure of your data requires your prior consent, the Company will obtain your consent by the requirements and conditions of relevant laws.
Your Rights under the Personal Data Protection Act B.E. 2562 (2019) The Personal Data Protection Act B.E. 2562 (2019) aims to give you more control over your data. You can exercise your rights under this Act when the provisions relating to the rights of data subjects come into force, as detailed below:

The right to access and receive a copy of your data, including requesting disclosure of the source of your data collected by the Company without your consent, except in cases where the Company has the right to refuse your request under the law or court order, and in cases where your request for access and a copy would affect the rights and freedoms of others.

The right to request correction of your inaccurate or incomplete data, to ensure its accuracy, up-to-dateness, completeness, and that it does not cause misunderstanding.

The right to request the organization to suspend the use of your data in any of the following cases:

When the Company is conducting an investigation following your request to correct your data to be accurate, complete, and up-to-date.

Your data has been collected, used, or disclosed unlawfully.

When your data is no longer necessary for retention according to the purposes notified by the Company to you during collection, but you wish for the Company to continue storing the data to exercise your rights under the law.

When the Company is proving the lawful grounds for collecting your data or verifying the necessity of collecting, using, or disclosing your data for the public interest due to your exercise of the right to object to the collection, use, or disclosure of your data.

The right to object to the collection, use, or disclosure of your data, except in cases where the Company has lawful grounds to refuse your request (e.g., the Company can show that the collection, use, or disclosure of your data has a more legitimate legal basis, or for the establishment of legal claims, compliance with, or exercise of legal rights).
Retention Period of Personal Data The Company retains your data for the following periods:

For trainee data: Retained for 1 year from the date your relationship with the Company ends.

For test taker data: Retained for 1 year from the date your relationship with the Company ends.

For instructor data: Retained for 1 year from the date your relationship with the Company ends.

For website user data: Retained for 1 year from when the Company receives the personal data.

For other related persons' data: Retained for 1 year from when the Company receives the personal data.
After the periods above, the Company will delete or destroy your data when it is no longer necessary for the purposes notified to you. However, in cases where the Company needs to retain some data for your benefit, such as creating and maintaining an alumni directory or your certificate as proof of your training, or in cases where you exercise your rights or have disputes or lawsuits regarding the training, being an instructor, or using your services, the Company reserves the right to retain such data until the specified task requires cancellation or the dispute is finally resolved by a court order
